Canada is a federal nation. Like all federations, legislative power is divided between national and sub-national units. In Canada, these powers are largely set out in ss. 91 and 92 of the Constitution Act, 1867.1 Section 91 grants to the federal Parliament certain exclusive powers over certain subject matters, and s. 92 grants certain other legislative powers to the provinces. There is no true residuary power.2
