The Courts Are Picking Up the Cyber Pace

There is an emergence of a de facto legal “standard of care” related to cyber risk management. This chapter highlights several foundational and recent privacy and cybersecurity legal cases that boards of directors should be mindful of, especially those of public companies. These cases may represent a trend toward expectations for greater board accountability for cyber risk management oversight.
