Legal Issues Related to China International Commercial Court

On January 23, 2018, the second meeting of the Central Leading Group for Comprehensively Deepening Reform adopted the Opinions on the Establishment of the Belt and Road Dispute Resolution Mechanisms and Institutions (hereinafter referred to as the “Opinions”). The Opinions pointed out actively promoting “Belt and Road” international cooperation, properly resolving commercial disputes arising from the development of the “Belt and Road” initiative in accordance with the law, and through the establishment of “Belt and Road” international commercial dispute resolution mechanisms and institutions, providing equal protection of the legitimate rights and interests of Chinese and foreign parties, creating a stable, fair, transparent and predictable business environment governed by the rule of law. On June 27, 2018, the Supreme Court of China promulgated the Provisions of the Supreme Court of China on Several Issues Regarding the Establishment of the International Commercial Court (hereinafter referred to as the “Provisions”).
