Application of Public Policy in Judicial Review of Arbitration

In practice, the parties will exhaust all reasons to defend against the applicant's revocation, non-recognition and non-enforcement of the arbitral award, and the public policy clause is the main reason cited by the parties. As far as China is concerned, arbitral awards can be divided into domestic awards, foreign-related awards and foreign awards. Although there are public policy clauses in the abovementioned regulations on setting aside and nonenforcement of arbitral awards, there are few successful cases in which public policy is invoked.
