India’s Laws on Child Sexual Abuse (CSA)

In India, the problem of child sexual abuse (CSA) has just lately been highlighted in the media. The passing of POCSO 2012: the Protection of Children Against Sexual Offences special law, which makes an array of crimes such as exploitation for pornography, harassment of children, and child rape illegal, is a positive move. The statute requires the establishment of Special Courts to enable swift trials in CSA cases. This chapter’s objective is to inform readers about the rules that the government has passed to keep children safe from child sexual abuse (CSA) instances, and how well they are being carried out in society. The absence of much-needed victim support once a case is reported, in terms of legal representation and the designation of a support person, raises significant concerns about the justice system’s response to sensitive cases of sexual assault. Because of a lack of development, our nation’s system of child protection is unable to handle the enormous number of child sexual abuse cases. The Protection of Children from Sexual Offences (POCSO) Act’s regulations cannot be followed by children’s protection system.
