Can the Right to Explanation in GDPR Be a Remedy for Algorithmic Discrimination?

Since the birth of computation with Alan Turing, a kind of “excellence/extraordinary” and “objectivity” has been attributed to algorithmic decisionAlgorithmic decisions-making processes. However, increasing research in recent years has revealed that algorithmsAlgorithms and machine learningMachine learning systemsSystem can contain disturbing levels of biasBias and discriminationDiscrimination. Today, efforts have accelerated to include “fairness”, “transparencyTransparency”, and “accountabilityAccountability” features of algorithmsAlgorithms. In this paper, in this new environment created by algorithmsAlgorithms, whether the “right to explain” regulation in the GDPRGeneral Data Protection Regulation (GDPR), which entered into force on April 25, 2018, in the EU, can be used as a remedy and its limits will be discussed.
