AI is of significant benefit to the welfare society. Thanks to large-scale dataData analysisAnalysis, it becomes easier to identify deficiencies in the implementation of social policies and the allocation of social benefits. However, dataData-driven tools may also create risks to the access to private and public services and the enjoyment of essential social rightsSocial rigshts. This is also bound up with the principle of equality and non-discriminationNon-discrimination. Due to the increasing use of AI systemsAI systems, the potential risks arise in various areas. Besides a serious transformation in the labor market with the AI technologyTechnology, algorithmsAlgorithms are used to measure the performance of employees and manage all stages of the employmentEmployment including recruitmentRecruitment process. In addition to its impact on the right to work, AI systemsAI systems are also deployed in the context of accessing social services. The use of AI in order to verify identities, prevent fraud, and calculate benefits may limit the enjoyment of social rightsSocial rights and discriminate against vulnerable groups of society. For this reason, there is a need to examine the place of social rightsSocial rights in the application of AI technologyTechnology. This study seeks to carry out an analysisAnalysis on how AI affects social and economic rights in the light of the principle of non-discriminationNon-discrimination. To achieve this aim, relevant legislation and court decisions will also be examined.
