Just or Necessary? Socio-Legal Issues in the Experiences of Muslim Polygamy in Malaysia

An alternative approach to understanding the legal context of polygamy is to analyse the actual experiences of parties to polygamous marriages in their dealing with the law. This chapter assesses how parties to Muslim polygamous marriages in Malaysia have interacted with the law and various forms of legal intervention established by the state. It also evaluates the knowledge of the parties concerning the requirement of the law in contracting polygamous marriages and the parties' compliance with the law. Its end objective is to establish whether the regulatory framework of Muslim polygamy in Malaysia achieves the underlying provision of justice to all parties involved in a polygamous marriage.
