Can AI Help Indian Judiciary to Reduce Its Burden of Cases? Exploring the Potential of AI in Judicial Decision-Making Process

At this juncture, the thing that is most concerning to the legal fraternity is the number of pending cases in India, so finding an appropriate solution by exploring the potential use of AI, is what the paper aims at. Therefore, the paper considers the option of using AI to assist the courts in the speedy adjudication of cases, which is fundamental in a welfare state because justice delivery mechanism is the primary means of justice delivery. Although in the European Union and in China the concept of Robo-Judge has come up which adjudicates particular types of cases, this paper propose to incorporate independent Generative AI tool for adjudication pending of cases to work as an Augmented Intelligence whose primary purpose would be to assist the judge in the research work of a case and to come up with a probable judgement. It would depend upon the discretion of the judge whether to accept the suggestions generated by AI or not. The judge will be at liberty to use his own reasoning while giving a judgement and may use AI as a mere expert opinion. An important factor to achieve this end is ensuring the accuracy of data accessible by the AI tool, responsible for the suggestions generated.
