While hearing actions of performance of statutory duties, if a definite conclusion on the justification of the grounds on which citizens, legal persons or other entities request administrative organs to perform specific statutory duties cannot be drawn, it is appropriate for the administrative organs involved makes new decisions based on further investigation and discretion through renewed administrative procedures and a people’s court shall rule that the administrative organs involved re-handle the applications from citizens, legal persons or other entities.
