The Principle of Good Faith (PGF) is a basic principle China has adhered to and plays a leading role in judicial judgment. This case involved applicants’ registration of a plethora of trademarks (including the trademark involved) for purposes other than use and out of no reasonable or justifiable reasons and an attempt to profiteer through assignments of hoarded trademarks and/or legal proceedings. Their act seriously disturbed the normal order of trademark registration, damaged public interests, and improperly exploited public social resources. Having failed to assign the registered trademark involved to their targeted assigns, the applicants proceeded to sue the targeted assigns and their different outlets as joint defendants for the same cause of claims of trademark right infringement and on substantially identical facts, building up a series of related actions across the country. Therefore, this case is a typical violation of the PGF.
