A Comparative Analysis of the Rule of Law in India and Australia and Their Adherence to Constitutionalism

India and Australia, both Commonwealth countries, offer a unique opportunity for comparative studies regarding the rule of law. While both nations share historical ties, their approaches to the rule of law exhibit distinctive characteristics. In India, the Dicey Concept of the Rule of Law, as espoused by Professor A.V. Dicey in the UK, is enshrined in the constitution. In contrast, Australia upholds the Rule of Law as a longstanding tradition deeply embedded in its legal system. This paper delves into the significance of the Rule of Law, a cornerstone of constitutionalism within a state. Professor Dicey, in his seminal work “An Introduction to the Law of the Constitution,” expounded on the Rule of Law, attributing three interconnected meanings to it. First, it emphasizes that individuals can only be penalized through due legal process in established courts, asserting the supremacy of the law over arbitrary power. Second, it underscores the equal subjection of all to ordinary legal courts, ensuring equality before the law. Lastly, it pertains to individual rights determined and enforced by the courts, emphasizing just and reasonable laws that respect personal liberties. In India, the “procedure established by law” doctrine prevails, limiting judicial interpretation to literal compliance with laws. Australia, on the other hand, integrates the Rule of Law within its democratic and legal framework, emphasizing transparency, fairness, and the applicability of laws to all. This paper also examines relevant legal cases in both countries, demonstrating how the rule of law has shaped legal decisions and influenced constitutional principles. It highlights the crucial role of the rule of law in maintaining a balance between individual liberties and public order. The fundamental role of the Rule of Law in both India and Australia is crucial in maintaining justice, fairness, and individual freedom. This comparative analysis showcases the different approaches each nation takes to uphold this essential principle, shedding light on their distinct constitutional systems and historical backgrounds.
