Legal, Ethical, and Social Ramifications of the Use of Artificial Intelligence in Decision-Making: A Comparative Analysis of the European Union and Indian Law

摘要

Artificial Intelligence (AI) is one of the most essential and rapidly evolving emerging technologies. Transformational changes through AI in the future may see a significant improvement in global conditions. In contemporary legal discourse, many practical issues are intractable to address with the most powerful supercomputers, and the use of AI may give a chance to tackle such problems and challenges effectively. AI can emulate processes to develop medicine, and material design, accelerate development, and offer a new level of information security and communication. These are just a few of the advantages of AI, but AI may also be misused, and thus it may create risks. Presently, in most countries, there are no guidelines concerning the use of AI in human decision-making, so in the absence of any guidelines and/or effective laws, it would be challenging to provide appropriate relief if any dispute arises. The present research analyzes the legal, ethical, and social complications and discusses the advantages and disadvantages of the use of AI in human decision-making. The study proposes practical ways by which certain checks and balances might be incorporated into law for adjudicating matters concerning AI. The research suggests legal frameworks by comparing and analyzing Indian and European Union (EU) laws to direct governance and policy responses vis-a-vis AI.
