A Legal Framework of Probation of Offenders in India: An Analysis with Special Reference to Australia and the USA

The criminal justice system’s effectiveness against rising crime rates results in more convictions, necessitating efficient ways to reduce jail overcrowding, solutions to rising prison costs, and the finest correctional technologies. Probation is the optimal correctional response, and its comparative study is vital due to potential challenges from events like COVID-19 and extensive migration, coupled with rising cyber transactions resulting from liberalisation and globalisation. In this comparative study, researchers attempt to examine the implementation of the penal philosophy of rehabilitation of offenders under the legislation on Probation of Offenders in Australia, the USA, and India for an effective and advanced system of probation offenders in India to address the present and future challenges. Findings highlight legislative definitions, sentencing guidelines, probation conditions, and conviction-free orders focused on rehabilitation. Researchers propose adaptable sentencing guidelines for an enhanced and advanced Indian probation system to tackle present and future challenges.
