There is no single ‘Disaster Law’ in Australia, as the Commonwealth Australia Constitution Act (the Constitution) devolves certain powers to State and Territory Governments. The National Emergency Declaration Act 2020 provides for preparing for, responding to, and recovering from emergencies that cause or are likely to cause nationally significant damage. It assists the Federal Government and the State and Territory Governments in managing emergencies, and allows State and Territory Governments to implement local disaster laws simultaneously. This chapter briefly introduces the natural hazard crisis in Australia, addresses case study of Queensland floods 2010–2011 and New South Wales black summer bushfires 2019–2020, and focuses on the Australian perspectives on disaster regulation.
