Legal Challenges Regarding Digital Operations

摘要

The chapter makes the case for a clear analytical division between the fields of law and technology. The extent to which legislation “may” be computerized is a legal matter; however, the extent to which the law “should” be digitalized is a technological one. In the light of this, some contend that technological advances do not inherently undermine the law. Rather, the finer points about the interplay between digitalization and the law are what really matter. These are the problems posed by the chapter, which also offers a theoretical structure for both digitalization and the digitalization of law.
