Good Faith in the Australian Context

The aim of this chapter is to provide an overview of the development of good faith in Australia. In Chap. 2 , the importance of good faith obligation as a concept has been recognised historically in its ability to provide courts with a basis with which new rules can emerge to deal with developments in commerce that cannot be satisfactorily resolved under existing rules. This has led to the development of positive law to meet the progressive need of commercial life both within civil and common law jurisdictions.
