The Obligation of Good Faith in Chinese Contract Law

Good faith is regarded as one of the fundamental and general principles in the 1999 Contract Law of the People’s Republic of China (‘the 1999 CCL’). Chinese academics and courts have generally accepted and embraced the principle of good faith as an indispensable principle of the 1999 CCL. It is, therefore, of great importance to understand the meaning, functions, and scope of the obligation of good faith before considering the application of it in practice.
