Harmonization of the Enforceability of Interim Measures Granted by an Emergency Arbitrator in International Commercial Arbitration

Along with the process of regionalization and globalization, international commercial arbitration has witnessed a movement towards harmonization. Harmonization can reduce conflicts between practices by state courts located in different jurisdictions and overcome potential obstacles to guarantee the enforceability of interim measures granted by an emergency arbitrator. This chapter starts with a general introduction of the concept of legal harmonization with a focus on international commercial arbitration and then gives an analysis regarding the conflict between harmonization and diversity in this area of law. The discussion on the necessity of harmonization regarding the enforceability of the interim measures granted by an emergency arbitrator will follow. This chapter further proposes several possible ways to harmonize the enforceability of the interim measures granted by emergency arbitrators.
