Public Policy

In the case of recognition and enforcement of foreign arbitral awards, violation of public policy is often raised by the losing party to the arbitration to contest the validity of the award. According to the provisions of relevant international treaties and Chinese laws, public policy can be used as one of the main grounds for refusing to recognize and enforce foreign arbitral awards, and can also be used as one of the negative situations for the interregional enforcement of arbitral awards between the Chinese Mainland, Hong Kong, Macao and Taiwan.
