Jiangmen Haoyin Trade Co., Ltd. v. Union Logistics Inc.

Plaintiff shipper sold a batch of goods to Outsider Adorn and entrusted Shengyang (the carrier’s agent) to arrange for the ocean transportation of the goods involved on its behalf. The goods were shipped by Defendant carrier from Yantian Port to Long Beach, U.S.A., and, as a result of the receipt of a letter of guarantee from Adorn, the goods were released to Adorn without a bill of lading. After the shipment of the goods involved, shipper entrusted CITIC Jiangmen to handle the immediate documentary collection. CITIC Jiangmen sent the original documents, including the original bill of lading involved, to the collecting bank, and sent a single-sided letter instructing the payer to be Adorn. Adorn never paid the collection bank to redeem the bill, and CITIC Jiangmen received the full set of documents returned by the collection bank and returned them to shipper.
