Plaintiff infringed and the village committee concluded a beach contract under the witness of the legal service office, agreeing that Plaintiff would pay a contract fee of 500 yuan to the village committee every year, and during the contract period, with the consent of the village committee, Plaintiff could transfer the beach to others for management. Defendant infringer also concluded a contract with the village committee to contract the beach, and the beach contracted was adjacent to the beach contracted by Plaintiff. After Plaintiff subcontracted 183.5 mu of beach to Outsider YU Mou in the case to breed corbicula, due to a dispute over the demarcation of beach, Defendant reported to the police station, but the mediation was ineffective. Defendant still occupied part of Plaintiff’s beach, resulting in a certain free range of 50 acres of clams, the remaining 130 acres of Defendants encroached. YU Mou asked Plaintiff to return the above 130 acres of beach contract money and tideland labor costs. Therefore, Plaintiff filed an action, asking Defendant to stop the encroachment, return the encroached beach of 133 acres, and compensate for the loss.
