Plaintiff was owner of one-seventh of the shares in M.V. “Zhe San Yu 00,011”. (He owned half a share in the vessel, which was divided into 3.5 shares.) During 2014, Plaintiff withdrew his share in return for payment, which was made by the registered owner, the first Defendant. Before Plaintiff withdrew his share, the vessel became entitled to receive a diesel oil price subsidy from the government. After Plaintiff withdrew his share, M.V. “Zhe San Yu 00,011” sank after a collision with a Liberian-flagged container vessel. The local maritime authority, the Marine and Fisheries Bureau of Sanmen County, incurred wreck removal expenses in the amount of RMB1.5 million yuan, and it withheld payment of the diesel oil price subsidy for 2014 and 2015, as well as another power reduction fund, as a means of recovering the wreck removal expenses.
