Plaintiff, Tourism Investment Development Co., Ltd., filed this suit asking the court to compel Defendant, YOU Liande, to hand over possession and management of the leisure fishing boat Zhe Ning Yu Xiu 66031 to Plaintiff or to pay the sum of RMB186,287 yuan as compensation on the ground that the boat belonged to Plaintiff, which had bought it from Ninghai Yulaoda Tourism Development Co., Ltd. Defendant argued that although the certificate of registration of the boat bore the name of Ninghai Yulaoda Tourism Development Co., Ltd. at the time that the Plaintiff claimed to have bought the boat, Defendant was the actual beneficial owner of the boat at that time and also the manager in possession. Defendant also argued that he had an agreement with Ninghai Yulaoda Tourism Development Co., Ltd. to sell the boat to it for 79,556 yuan, with the result that Ninghai would take over possession and management of the boat.
