Plaintiff ship builder applied from Defendant insurer for a ship under construction in the amount of RMB140,000 yuan and agreed that the coverage of the insurance should include loss arising from errors in design of any part of the ship and the exclusion of liability should include fines stipulated in the construction contract and indirect loss arising from rejection and other causes …… The insured ship was built by Plaintiff for Outsider shipowner. The two parties concluded a shipbuilding contract, under which Plaintiff guaranteed that the deadweight tons of the insured ship should not be less than 16,900 metric tons with a freeboard draft of 8.25 m, and the actual deadweight tons of the ship should not exceed 250 metric tons. If the actual deadweight tons were less than 600 metric tons, the shipowner had the right to abandon the ship.
