Rural Land Transfer in China: Reform and Legal Issues

Three Rural Issues have been the focus of the central governmentgovernment and they are closely connected with rural landland. ChinaChina has witnessed a rapid development in urbanization since the twenty-first century. As a large number of peasants migrate to cities, more and more lands in rural areas become idle. The issue of transfer and use of idle land effectively has remained an eminent issue facing the government, and it has over time attracted much attention from academics. This article reviewed rural land reformland reform programsrural land reform programmes carried out in the past forty years, analyzed the changes of land transferland transfer, and examined the relevant legal issues from three aspects: right to contractual management of land; right to use house sites, and right to use land for construction purposes. This article can help the government to locate issues arising from land system, to remove institutional barriersinstitutional barriers, and to further deepen land reform, promoting rural developmentrural development in China.
