Managing Construction Claims and Conflicts: Insights from Peru

The construction industry in Peru is characterized by stringent project deadlines, frequently shifting worksite locations, and the formation of temporary workgroups. These challenges often give rise to conflicts and claims, which can significantly disrupt the smooth progress of construction projects. Consequently, the primary goal of this investigation was to investigate the root origins of these claims and conflicts specific to the Peruvian construction sector. To achieve this goal, extensive data was collected through comprehensive surveys, and a robust statistical analysis was employed to discern sector-specific trends. The principal findings of this research reveal that a significant portion of claims in the Peruvian construction sector are mainly responsible for changes in design plans or specifications. This finding emphasizes the critical importance of effective management strategies for dealing with design-related alterations. To this end, the study recommends the implementation of a well-structured approach encompassing payment procedures, bidding processes, and contracting strategies. These recommendations aim to improve project management and reduce the likelihood of disputes related to design changes. The contributions of this study to the field are twofold. Firstly, it offers construction experts in Peru a thorough grasp of the main reasons behind disputes and conflicts within their field, facilitating informed decision-making and proactive dispute management. Secondly, it offers practical guidance on implementing strategies to mitigate these challenges effectively, thereby promoting project success in a dynamic and demanding construction environment.
