This chapter explores the forensic psychiatry issues pertinent to the perinatal period within the South Asian context, focusing on challenges such as infanticide, pseudocyesis, delusional pregnancy, baby snatching, forced mother-child separation, child custody loss, and fitness to take care of child assessments among mothers with mental illness. It examines legal frameworks like the Mental Health Care Act and Juvenile Justice Act, alongside criminal responsibility laws in different South Asian countries, contrasting them with Western standards. The chapter highlights specific case laws, the status of incarcerated mothers, prison mental health services, and the magnitude of perinatal crimes. It identifies gaps in legal mechanisms, cultural dilemmas, and resource challenges, proposing a way forward for improving forensic psychiatric evaluations and maternal mental health support in South Asia.
