Green and Low-Carbon Development in the Environmental Code: Institutional Design and Systemic Integration

Green development, as a development model characterized by low energy consumption, low pollution, and low-carbon emissions, constitutes a crucial component in promoting the sustainable development of the economy and society. The codification of China’s Environmental Code necessitates the establishment of a dedicated section on green and low-carbon development to ensure the coexistence of economic growth and sustainability through legal mechanisms. The Green Development section should adopt sustainable development as its logical framework, clarifying the rights, obligations, and functional authorities of diverse stakeholders, establishing guidelines for resource recycling and reuse, and constructing regulatory mechanisms to standardize multi-party behaviors. To achieve this, the General Provisions should define the concept and normative significance of “green and low-carbon development”, while incorporating its fundamental principles, green planning, the allocation of rights and obligations among diverse stakeholders, and the basic institutional frameworks for green and low-carbon development. On the other hand, specialized chapters addressing climate change, green and low-carbon energy systems, resource conservation, and circular utilization, among other critical areas, should be established to specify actionable measures and detailed provisions for advancing green and low-carbon development.
