In the beginning of this chapter, I discuss critically the meaning of civilians and civilian objects, and the principle of distinction. Subsequently, I discuss three important humanitarian challenges to the distinction principle in the contemporary warfare: (1) how to distinguish in asymmetrical warfare; (2) disputed meaning and scope of the phrase “direct participation by civilians in hostilities,” and (3) whether child soldiers may be targeted. The analysis refers to the current armed conflicts between Israel and Palestine, and Russia and Ukraine, and contextualizes the problematic side of the principle.
