Consequential and Indirect Losses
摘要
A breach can have several consequences. The contracting parties would invariably get into a dispute on the extent to which the effect of the breach should be taken. A limitation of liability clause excludes or limits liabilities by employing terms indirect losses, consequential losses and loss of profit. The meaning and scope of these terms have been disputed in the context of the contract. The chapter reviews the court judgments on the limitation of liability clauses.
