This chapter will return to the perspective of traditional legal systems, distinguishing between different types of transaction models and providing a detailed analysis of how intellectual property transactions are conducted. It is well known that intellectual property transactions include three forms: assignment, licensing, and capital operations. Legislative rules have been designed for each type of intellectual property transaction, but they are often rough, showing not only logical confusion in emphasizing the coordination between the special attributes of intellectual property and the application of basic principles of civil law, but also failing to meet the practical needs of industrial development. In view of this, this chapter aims to explore the effectiveness and shortcomings of the current system by examining the specific types of intellectual property transactions and to propose institutional improvement schemes based on this analysis.
