The Transformative Impact of Technology in Shaping Modern Dispute Resolution

The increasing use of Online Dispute Resolution (ODR) systems highlights the evolving role of Information and Communication Technology (ICT). ICT includes systems like Artificial Intelligence (AI) and machine learning. AI and machine learning offer unique and effective resolutions to online as well as offline disputes. It is proven they are an active factor in handling disputes. The basis of this study is the need to understand the changing scope of ODR. This study aims to analyze how ODR affects traditional dispute resolution frameworks. A number of technologies are employed, and various dispute types are tackled. This creates complexity in defining ODR. This raises questions about its classification. Is it a standalone domain? Or is it an extension of conventional methods? An in-depth analysis is conducted in this study. This analysis shows that ICT acts as the “fourth party” in ODR, automating and facilitating resolution processes. It does this task right alongside the “fifth party”. The fifth party includes technology providers who are responsible to develop and manage platforms. The results affirm that ICT serves a dual role. It works not only as a supportive tool but also as an active resolution participant. The study stresses the importance of incorporating dedicated technological frameworks which are essential to modern dispute resolution. The study also discusses the implications of the integration on the future of ODR.
