“Legal Orientalism” is the application of “Orientalism” in the legal domain, which directly refers to the legal image of a nation. As a discourse system of the national legal image, it has its history and roots during the course of forming. Before the nineteenth century, China’s legal image, other-shaped by the Western world, presented a utopian perfect imagination. In the nineteenth century, its Spreading in the Western world was gradually labeled as a typical example of “barbarism” and “backwardness”. From the perspective of “Orientalism”, the essence behind the “other-shaping” of China’s legal image in the nineteenth century is imperialist ideology, which seeks extraterritorial rights, measures Chinese law according to occidental standards of “civilization”, and safeguards commercial interests and hegemonic status of Western enterprises in China. “Oriental Legalism”, as a transcendence of “legal orientalism”, in the final analysis refers to the question of how to build the discourse system of Chinese rule of law. The “self-shaping” of China’s legal image in the new era needs grand narrative, thereby building the concept of great translation and broad Spreading underpinned by a large pattern and vision.
