Findings and Conclusion
摘要
Chapter 7 synthesises the findings of this book, which examines the governance of Traditional Medical Knowledge (TMK) in China, focusing on reconciling its unique cultural and historical context with globally recognised mechanisms, including Intellectual Property (IP) frameworks, Access and Benefit-Sharing (ABS) systems, and TMK information systems. It highlights the challenges of integrating Western-centric structures into China's distinct TMK ecosystem, emphasising the need for culturally sensitive adaptations. This chapter argues for a holistic approach that balances protection, responsible utilisation, and dissemination of TMK, while respecting its cultural significance and community origins. Key contributions include a critical legal analysis of China's IP and ABS frameworks, revealing biases and suggesting reforms to address structural inequalities and enhance TMK governance. It proposes innovative solutions, such as a tiered system for TMK classification and a dynamic, inclusive TMK information system, designed to empower local communities and reflect China's diverse sociocultural landscape. This chapter also underscores the global relevance of China's experience, advocating for a culturally nuanced approach that could serve as a model for other nations managing traditional knowledge. Finally, it identifies future research directions, including the impact of customary laws and emerging digital technologies on TMK governance, and calls for a shift from purely legalistic frameworks to cooperative, context-sensitive strategies. This chapter concludes by highlighting China's potential to lead global efforts in TMK preservation and governance, aligning cultural heritage with international standards to promote sustainable and equitable knowledge sharing.
