Criminal Law in the People’s Republic of China: Principles and Practices in the Protection of the Child

This chapter Centers on the protection of children’s rights and interests under the Criminal Law of the People’s Republic of China, and in compliance with the principles enshrined in the United Nations Convention on the Rights of the Child, this chapter conducts an analysis from two core dimensions: “children as subjects of criminal liability” and “children as victims”. By adopting the dual approaches of “exercising leniency toward child offenders” and “imposing severe penalties on crimes against children”, it constructs a criminal protection system covering all scenarios of children’s rights and interests. This system embodies the domestic integration of the spirit of the United Nations Convention on the Rights of the Child within China’s legal framework. Furthermore, it provides crucial criminal law support for the development of a distinctive legal regime for the protection of children’s rights and interests in China.
