The Civil Code of the People’s Republic of China: Foundations for the Civil Rights and Protection of the Child

This chapter takes the civil protection of children’s rights and interests in the Civil Code of the People’s Republic of China as the research object, with “rights protection” as the core element. It takes the provisions concerning children’s rights in the Civil Code of the People’s Republic of China as the main content. This law safeguards children’s capacity for civil rights, civil capacity, and statute of limitations, as well as children’s personal and property rights, to safeguard children’s healthy growth in a multi-dimensional and multi-faceted manner so as to maximize children’s interests. It constitutes a foundational normative framework in civil law for other specialized child protection statutes and holds significant theoretical and practical value for developing a distinctively Chinese legal regime for the protection of children’s rights and interests.
