Operationalizing the Best Interests of the Child: Juvenile Protection in China’s Community Correction System

This chapter analyzes the special protection mechanisms for juvenile offenders under China’s Community Correction Law, focusing on how the legislation safeguards the rights and interests of juvenile community correction subjects and facilitates their successful reintegration into society. It first outlines the development of China’s community correction system, highlighting key milestones such as the 2011 inclusion of community correction in the Criminal Law Amendment (VIII) and the enactment of the Community Correction Law in 2019. The chapter then analyzes the law’s general provisions, including working principles, applicable objects, execution locations, and responsibilities of competent authorities. Emphasis is placed on the special provisions for juvenile community correction, such as differentiated correction measures, strengthened family guardianship responsibilities, protection of identity information, and support for education and employment. These provisions reflect the principle of “education first, punishment as a supplement” and align with the United Nations Convention on the Rights of the Child, particularly the best interests of the child principle. The chapter concludes that China’s legal framework for juvenile community correction aims to balance supervision, education, and assistance, ensuring juveniles’ rights to education, privacy, and social reintegration while preventing recidivism.
