Compliance Mechanisms of China’s Cross-Border Data Transfer Regime

As economic globalization and digitization progress, cross-border data transfer (also referred to as 'data export' or 'data outbound') has become a key driver of the global economy. China highly values the regulation and security of cross-border data transfer and aims to build a scientific, reasonable and balanced data governance mechanism that reconciles openness and security. China’s cross-border data transfer mechanism has developed from fragmented regulations to a comprehensive legal framework, anchored by Cybersecurity Law of the PRC (CSL), Data Security Law of the PRC (DSL), and Personal Information Protection Law of the PRC (PIPL). It establishes a legal foundation for the entire data-processing lifecycle. These laws clarify requirements for security assessments, risk control, and compliance obligations regarding data export, aiming to facilitate the flow of data resources, promote the growth of the digital economy, and safeguard national cyberspace security and personal information rights. The Provisions on Promoting and Regulating Cross-border Data Flow are a significant milestone in China’s cross-border data transfer mechanism. The Provisions mark shift from a regulation-oriented approach to a promotion-oriented approach. The regulation optimizes three core compliance pathways (security assessment, standard contracts, and personal information protection certification) and introduces the ‘negative list plus default exemption’. By clarifying regulatory standards, streamlining compliance processes, and refining security assessment parameters, it reduces enterprises’ compliance cost, enhances the vitality of digital trade in services, and supports the deep integration of China’s digital economy with the international market. China’s regulatory system features comprehensive, full-process supervision led by the Cyberspace Administration of China and coordinated governance between central and local authorities, and is strengthened by laws, regulations, standards and guidelines. Internationally, China actively engages in global digital governance via initiatives like the Global Data Security Initiative and the Digital Silk Road, and promotes dialog on adequacy recognition and aligns with regional frameworks. Based on China’s cross-border data transfer policies, regional cooperation initiatives and international trends, this chapter reviews the evolution and key mechanisms of China’s cross-border data transfer regime, guiding enterprises and institutions to meet compliance requirements and address global digital economy challenges.
