EU Legal and Regulatory Framework

This chapter examines the developing legal and regulatory framework governing third-party litigation funding (TPLF) within the European Union (EU). It analyzes how instruments such as Directive 2014/104/EU, the Commission Recommendation 2013/396/EU, and recent resolutions of the European Parliament have shaped national approaches to transparency, collective redress, and funder accountability. By tracing the differences in national transpositions and the EU’s progressively more structured policy direction, this chapter demonstrates how the EU is moving toward a more coherent regulatory model that seeks to expand access to justice while preventing financial and ethical risks in funded litigation.
