Economic freedom is a key driver of innovation and economic growth, but it must be carefully balanced with the interests of society and the state. This paper offers a legal analysis of the regulatory framework shaping economic freedom in Poland and the European Union, with a particular focus on constitutional principles, treaty provisions, and recent EU regulations such as the AI Act, the Digital Services Act, and the Digital Markets Act. The discussion emphasizes the theoretical and normative dimensions of regulation, highlighting potential opportunities and challenges for entrepreneurs. The study argues for the importance of a balanced and sustainable regulatory approach that safeguards fundamental freedoms while strengthening social and economic resilience.
