Based on previous analysis of Taishinin’s judicial behaviour by taking its five judgements on corruption under the social conditions at the time, this chapter analyses whether Taishinin could achieve internal independent governance without intervention. In the prewar state political system, it was difficult for Taishinin to be independent from other governmental institutions without being unduly influenced by them. While hegemonic power was fundamental in the governance of the prewar state political system, Taishinin strived to maintain it by fulfilling its mission, judicial responsibilities, sociocultural, sociopolitical and sociolegal role under prewar social conditions. This chapter further explores the phenomenon of Japanese body in Western jacket due to legal transplants during the Meiji period.

摘要
