Victim Impact Statements in the Indian Criminal Justice System

This chapter critically examines the multifaceted role and impact of victim impact statements in the criminal justice system. It focuses on insights from the jurisdictions of common law which are the United States, the United Kingdom, South Africa, and Canada. This study focuses on the impacts of victim impact statements on providing sentences, the psychological well-being of victims, various challenges associated with this context, and also the legal groundwork in that field. Victim impact statements have the capability to support the victims of crime by ensuring that their perspectives are taken into the judicial process. There are various challenges to victim impact statements in India because of the procedural, cultural, and legal dimensions present in the country. This chapter demonstrates the importance of a multifaceted approach that not only considers the perspective of the victims through victim impact statements but also gives importance to the complications of the adversarial system, in the purview of which, the rights of the victims have outshined the participation of victims. The objective of this chapter is to inculcate an impartial and supportive legal system that corresponds with international approaches that are embedded in the sociocultural context by promoting reforms in the judiciary and facilitating victim support mechanisms. This multidimensional approach towards victim impact statements aims to facilitate reforms from a procedural and legislative view that enhances and ensures that justice prevails with a victim-centric approach in the legal system of India. This nuanced understanding of victim impact statements seeks to catalyse legislative and procedural reforms that enhance the delivery of justice by ensuring a more victim-centric approach within the Indian legal framework.
