This chapter addresses gender as the second point of intersection in the three-point intersectional lens proposed in this book: race and gender. The chapter utilises Feminist Legal Theory (FLT) as a tool of both theory and praxis in the context of the historical development of the feminist movement more broadly and examining the ways in which FLT and its various limbs have influenced Western laws and systems of justice. This chapter also addresses the strengths of the various FLT strands with regard to the operation of the Western criminal justice systems, both in Australia and overseas, and in particular its concurrent application with the notions of race set out earlier in this book. The chapter moves through some of the major waves in western feminism, from second wave feminisms like liberal feminism and cultural feminism, to the radical feminist preoccupation with sex, domestic violence, and power. The chapter draws together previous discussions of race with conceptions of gender and feminist theory, to consolidate the first two points of the three-point intersectional lens.
