Local Regulations: History, Status and Function

This chapter traces the evolution of local regulations in China. From 1954 to 1978, only autonomous regions enjoyed limited rule-making power; provinces and cities had none. The 1979 Local Organization Law first granted provincial legislatures authority to enact “local regulations,” and the 1982 Constitution affirmed this tier. The 2000 Legislation Law added “larger cities,” and the 2015 amendment extended the power to all prefecture-level cities, creating today’s 353 local legislative bodies. It details the four phases, analyzes the features, functions and achievements of local regulations, and summarizes the basic experience from the local legislation.
