Development and Innovation of Theory and Practice of Party’s Leadership in Legislation

This chapter explores the history of how the CPC has steered legislative development since 1949. It argues that CPC leadership is the defining feature of socialist rule of law and the key to building a modern Chinese legal system. Reviewing historical milestones, it shows that Party-led legislation has translated policy into binding national law while balancing central direction and local initiative. Since the 18th CPC Congress, the Party has improved institutional mechanisms to ensure law-making serves the people’s interests and the rejuvenation of the Chinese nation. It concludes that embedding the Party’s leadership throughout the legislative process safeguards socialist rule of law, advances state governance modernization, and offers an alternative path to legal development distinct from the Western models.
