As Non-Fungible Tokens (NFTs) captivate the digital world, their legal and regulatory challenges are becoming increasingly significant. This paper explores NFTs’ unique attributes and legal considerations, starting with their definition and nature, highlighting their differences from traditional digital assets. It examines the current legal frameworks for digital assets, providing insights into the evolving regulatory landscape for NFTs, cryptocurrencies, and tokens, and identifies critical gaps requiring further legal clarity. The paper then delves into ownership and transfer of NFTs, detailing the legal mechanisms underpinning these processes. Intellectual property considerations are scrutinized, analyzing the impact of NFTs on copyright, trademark, and patent laws, as well as on creators’ rights, licensing agreements, and enforcement mechanisms. Regulatory challenges, including investor protection, consumer rights, anti-money laundering regulations, and securities laws, are also addressed.
