Access to Justice as a Guarantee of Rights and Sustainable Development: The Case of Argentina

This chapter explores the intricate relationship between sustainable development and Access to Justice in Argentina. It will focus on the context of Argentina’s legal framework and its alignment with Sustainable Development Goal 16. Through the analysis of key legal doctrine, international law, case study, statistics analysis, and public policies review, the paper dives into how Access to Justice underpins the achievement of broader societal goals, including poverty reduction, gender equality, and environmental sustainability. By examining Argentina’s approach to improving historical and structural barriers to justice, this chapter argues that strengthening Access to Justice is crucial for legal fairness and a driving force for achieving sustainable development goals. This chapter concludes that the successful development of SDGs in Argentina can be attributed at least partially to moving from a focus on “Law in Books” to “Law in Action,” explicitly targeting these public policies into vulnerable groups, as seen in the case studies presented. Additionally, based on the case studies, some public policy paths to better integrate the development of SDGs in the legal system will be proposed.
