Service Design and Intellectual Property

This chapter systematically examines service design within the intellectual property framework through three progressive dimensions: conceptual foundations, typological applications, and governance mechanisms. Firstly, it is the conceptual definition of service design. Service design involves interactions and collaborations from multiple disciplines, integrating various professional knowledge and research methods from different fields. The discussion then explores three representative service design typologies through their distinct IP considerations. Digital service design engages with copyright protection for interfaces and algorithms, patent safeguards for API, and antitrust measures against data monopolies. Public service design primarily addresses regulatory compliance in healthcare applications and privacy governance frameworks. Product service system design incorporates engineering specifications and sustainable value networks to assess lifecycle costs while ensuring environmental and social benefits. Lastly, Service design, as an intellectual product, requires a tiered protection system that balances innovation incentives and fair competition. Its intangible, heterogeneous, and non-storable characteristics necessitate copyright as the core protection mechanism, supplemented by anti-unfair competition law as a safeguard, along with patents, design rights, and data compliance tools. This integrated framework spans digital interfaces, healthcare applications, and AI scenarios to provide comprehensive legal coverage.
