Overview of the Abuse of Market Dominance
摘要
Competition law around the world prohibits the abuse of market dominance. The US antitrust practices have been heavily influenced by Chicago School while the EU competition law is less affected under Article 102 TFEU. Antitrust experience from both sides of the Atlantic have substantial impact on China’s AML and its enforcement. This chapter argues that China has accepted an effects-based approach to anti-monopoly analysis, but focuses on more effects other than economic efficiency.
